Terms and Conditions of Sale
The buyer of Chadwick’s products accepts all the terms listed below:

  • Agreement

Chadwick’s Surfaces International, Inc. trades by this legally constituted terms of sale.  Invoices are written in response to a client’s purchase order, written or verbal, and this legally constitutes an agreement.

  • Pricing

Prices are F.O.B. Chadwick’s Surfaces International, Inc. warehouse, Libertyville, IL unless otherwise quoted in writing.  Please note that due to factors beyond our control, prices are subject to change without notice.  Unless otherwise specified, price quotes are valid only for material in stock at the time of the quote.

Prices are listed in commonly accepted units (square feet, pieces, sets).  Actual sizes may vary slightly or “nominally” from stated sizes on price sheets.  Selling quantities may be based on coverage with commonly accepted grout joint size included.  Some products are sold by the carton and those orders will be rounded up to the next full carton.

  • Placing An Order

To provide you with the best possible service, please fax or email purchase orders.  An acknowledgement will be faxed to you when the order is ready for pick-up.  Review acknowledgments for accuracy. No response deems approval.  Quantities are the ultimate responsibility of the purchaser.

Material in stock is not guaranteed available without a 50% deposit.

Special orders require a 50% deposit. The payment of the invoice balance is due upon the arrival of the material at Chadwick’s in Libertyville, IL.  Special orders cannot be cancelled once the deposit has been received.  Special orders are priced on an order-by-order basis.  Regular discounts do not apply.  Special order material is non-returnable and non-refundable.

Sorting of material is not allowed.  *Shade, size and finish variations are to be anticipated.  All natural material is not scratch-proof or stain-proof.  Any questions as to the acceptability of the product must be resolved prior to pick-up or delivery.

  • Sample Policy

Individual cuttings of stone, porcelain and ceramic tiles, are usually free of charge.  Full stone tiles and all moldings and decorative items will be invoiced as quoted.  However, if the items are returned within fourteen (14) days in saleable condition, a credit for the items may be issued.  Customers are responsible for all shipping charges incurred.

  • Slabs

Random slabs may be irregularly shaped and are sold by the square foot.  All slabs should be viewed and sized by the purchaser or authorized representative for suitability for intended use.  All sales are final.  Slabs are non-returnable and non-refundable.

  • Reserves

Reserves will be considered for a period of fourteen (14) days.  After that time, reserves will be automatically cancelled unless a written purchase order and a 50% deposit has been received.  All material is subject to prior sale, unless a deposit or payment has been received.

  • Warehouse Storage

All orders stored in Chadwick’s warehouse must be paid in full.  No refunds or exchanges will be allowed.  Storage fees will be applied to material left in our warehouse over 30 days.

Chadwick’s Surfaces International, Inc. is not responsible for materials left in our warehouse past 30 days of order confirmation date.  If material is stored in Chadwick’s warehouse, Chadwick’s can not be held liable for damage to those materials and/or any situations associated with that damage.

  • Payment

Cash before delivery is required on accounts that have not been approved for credit.   Credit will only be granted to accounts after a credit application process has been completed and approved by notification.  Note:  The first three orders remitted to us will be on a CBD basis.  Interest at 1-1/2% per month will begin on the first day payment becomes past due.   Payments may be made by cash, check, Visa or Mastercard.  There is a $5,000 limit on credit card purchases and anything over that amount is subject to a 2% surcharge.

  • Returned Checks

There will be a $50 service charge for all returned checks.  NSF checks will be returned to customers after they have paid their account in full by cash or cashier’s check only.

  • Delivery

Shipping instructions must be indicated on the purchase order. Incomplete instructions may delay a delivery.  Chadwick’s makes every effort to use the best packing material available for the delivery of its products, but damage may still occur during shipment.  Chadwick’s is not responsible for material after it leaves our warehouse.  Upon receipt of goods, the buyer should inspect the contents of the merchandise for quantity and freight damage.  If there are damage or quantity discrepancies, it should be noted on the delivery receipt and reported to the freight carrier immediately.  Chadwick’s does not arrange or guarantee the shipment of slabs.  Slabs shipping out-of-state are required to be paid prior to shipping.  (Claims for damage incurred during shipping are the responsibility of the purchaser.)

There is a $7.50 per carton packaging and handling charge on all UPS and Fed ex shipments.  UPS pick-up time is at 2:00 p.m. CST.  A $15.00 pallet charge will be added to the invoice. Additional pallet charges may be added to orders requiring pallet breakdowns.  For LTL shipments, extra crating charges will apply when an A-frame or crate is needed.

Freight deliveries are tailgate (or curbside if specified) only.  Someone must be present for unloading of the truck.  Freight companies charge “redelivery” fees if a return trip is required.  Delivery companies will charge a waiting fee if not immediately off loaded.  Clients are responsible for all such fees.

  •  Returns and Replacement

Prior written consent must be obtained from Chadwick’s before any return will be accepted.  Returns are subject to inspection and a 25% restock charge. Material must be returned in clean/original condition.  No returns after 30 days.  Special orders, support products, and slabs are non-returnable and non-refundable.

  • Customer Service
